1. Acceptance of Terms

By accessing or using Magenta (“the Service”), operated by KofiLabs (“we”, “us”, or “the Company”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

By sending a message to our WhatsApp number, you explicitly agree to these Terms of Service and our Privacy Policy. Your continued use of the Service through WhatsApp constitutes ongoing acceptance of these terms. If you do not agree, please do not message our WhatsApp number or use the Service in any way.

2. Description of Service

Magenta is a WhatsApp-based service that allows users to create landing pages for their businesses through conversational AI. The Service generates website content and code based on user inputs provided via WhatsApp messaging.

3. User Responsibilities

You agree to:

  • Provide accurate information about your business
  • Not use the Service for any unlawful purposes
  • Not upload or share content that infringes on intellectual property rights
  • Not attempt to abuse, hack, or disrupt the Service
  • Comply with WhatsApp's Terms of Service when using our WhatsApp integration
  • Use the AI assistant only for its intended purpose of creating business landing pages

4. Acceptable Use Policy

Magenta is designed to help small businesses create professional landing pages. You may not use the Service, including the AI assistant, to:

  • Generate content unrelated to legitimate business landing pages
  • Create websites for illegal activities, scams, fraud, or deceptive practices
  • Produce content that is harmful, abusive, harassing, defamatory, or discriminatory
  • Generate adult content, explicit material, or content inappropriate for general audiences
  • Attempt to manipulate, “jailbreak,” or circumvent the AI assistant's guidelines or safety measures
  • Use the AI assistant for purposes other than creating and editing landing pages (e.g., general chatbot use, homework help, content generation for other platforms)
  • Create content that promotes violence, hatred, or illegal activities
  • Impersonate other businesses or individuals
  • Distribute malware, phishing pages, or other malicious content
  • Engage in automated or bulk usage that places excessive load on the Service

We reserve the right to determine, in our sole discretion, what constitutes a violation of this Acceptable Use Policy.

5. Intellectual Property

You retain ownership of all content you provide to create your landing pages. The generated website code and designs created through the Service are licensed to you for your business use. KofiLabs retains ownership of the underlying technology, algorithms, and Service infrastructure.

6. Third-Party Services

The Service integrates with third-party platforms including WhatsApp (Meta), hosting providers, and AI services. Your use of these integrations is subject to their respective terms and privacy policies.

7. Limitation of Liability

The Service is provided “as is” without warranties of any kind. KofiLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

8. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We may also update these Terms of Service from time to time. Continued use of the Service after changes constitutes acceptance of the new terms.

9. Free Tier and Preview App Retention

For users on the free tier, preview apps (landing pages generated through the Service) may be automatically deleted after 30 days of inactivity. We reserve the right to remove or disable preview apps that have not been accessed or modified within this period to manage system resources.

Users on paid plans receive extended retention periods and additional features as specified in their subscription terms. If you wish to preserve your preview apps beyond the free tier retention period, we recommend upgrading to a paid plan or exporting your generated code.

We will make reasonable efforts to notify users before deletion, but we are not obligated to do so. KofiLabs is not responsible for any data loss resulting from the deletion of inactive preview apps on the free tier.

10. Termination

We reserve the right to terminate, suspend, or restrict your access to the Service immediately and without prior notice for any of the following reasons:

  • Violation of these Terms of Service, including the Acceptable Use Policy
  • Abuse or misuse of the AI assistant for purposes not aligned with creating legitimate business landing pages
  • Attempts to circumvent safety measures, rate limits, or security features
  • Creating content that is illegal, harmful, fraudulent, or violates third-party rights
  • Engaging in behavior that is abusive, harassing, or harmful to other users or to KofiLabs
  • Any other conduct that we determine, in our sole discretion, to be inappropriate or detrimental to the Service

Upon termination, your right to use the Service will immediately cease. We may delete your account data, generated landing pages, and any associated content without liability. We are not obligated to provide refunds for any prepaid fees in cases of termination for cause.

You may stop using the Service at any time by discontinuing communication with our WhatsApp number. To request deletion of your data, please contact us at support@magenta.app.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
